Marin County desalination plant plan suffers setback

SAN RAFAEL, Calif.

A county judge Tuesday ruled in favor of a lawsuit filed by opponents of the project, saying the environmental review was flawed, in part, because it failed to fully assess the impact on marine life.

Water district officials dispute that and have 60 days to appeal.

Back in 2009, the district approved a $105 million facility in San Rafael that would convert up to 15 million gallons of bay water into drinking water every day.
