23-year-old Daniel Dewitt is accused of beating 67-year-old Peter Cukor to death last month outside Cukor's Berkeley Hills home. Dewitt's family says he suffers from schizophrenia.
The case got national attention following reports that police failed to respond to a non-emergency call from Cukor reporting Dewitt as a trespasser before the attack.
Police didn't end up responding until after Cukor's wife called 9-1-1 to report her husband was being beaten to death.
