Attorneys to take San Jose's suit against MLB to High Court

SAN JOSE, Calif. (KGO) -- Attorneys for San Jose will take their antitrust case against Major League Baseball to the Supreme Court, hoping the Oakland Athletics can one day play ball in the South Bay.

The news comes after there was another legal defeat for San Jose. The Ninth U.S. Circuit Court of Appeals affirmed a lower court ruling by upholding Major League Baseball's exemption from antitrust laws.

San Jose hoped to strike down the exemption due in part to Major League Baseball's refusal to act on the A's efforts to build a stadium there. It remains to be seen whether San Jose will appeal to the Supreme Court.
