Judge dismisses Oakland's medical marijuana case

A federal magistrate has dismissed the City of Oakland's lawsuit to keep the nation's largest medical marijuana dispensary open.

The same judge had previously ruled that the Harborside Health Center can continue operating while it challenges a crackdown by the Justice Department which is attempting to seize the property.

Oakland contends its residents and taxpayers will be harmed if the center is forced to close but the judge says only the pot club and its landlords are entitled to sue.
