A Santa Clara County judge Wednesday denied the city of Gilroy's request for a temporary restraining order to close the Medileaf club.
The cooperative opened Nov. 8 even though the City Council rejected its business application..
The dispensary says under state law, as a non-profit, it is allowed to operate without a license.
Its founder says he is thrilled by the decision.
