The San Francisco Chronicle reports that the worker was placed on leave with pay back in October, when the DMV first started investigating.
Amber Yust says Thomas Dimartini sent her a letter quoting bible verses and begging her not to get a sex change after she went to the office in San Francisco to change her driver's license.
Yust has filed a formal complaint.
